La tutela del cultural heritage
The article aims at examining the current protection offered to cultural and artistic heritage, as an autonomous legal asset already defined by the Constitution, with a perspective look at the reform currently being approved in Parliament, which unless otherwise amended, will worsen the penalties in aversion to these goods, systematically introducing the title VIII bis in the Penal Code, with new specific crimes on the subject. Finally, in the concluding part, critical considerations will be offered on the current legislation on the subject of transnational circulation of artistic assets, as recently amended with Law 124/2017.
L’articolo si propone di esaminare l’attuale tutela offerta al patrimonio culturale ed artistico, quale autonomo bene giuridico definito sin già dalla Costituzione, con uno sguardo prospettico alla riforma attualmente in corso di approvazione in Parlamento, che salvo diverse ed ulteriori modifiche, inasprirà maggiormente le pene in avversione a detti beni, introducendo sistematicamente il titolo VIII bis nel Codice Penale, con nuovi specifici reati in tema. Nella parte conclusiva si offriranno, infine, considerazioni critiche in ordine all’attuale normativa in tema di circolazione transnazionale dei beni artistici, così come recentemente modificata con la L. 124/2017.
